Developing nations stand up to US/UN bullying on copyright

From “Statement by India at the Inter-Sessional Intergovernmental Meeting on a Development Agenda For WIPO, April 11-13, 2005” (emphasis added):

“Development”, in WIPO’s terminology means increasing a developing country’s capacity to provide protection to the owners of intellectual property rights. This is quite a the opposite of what developing countries understand when they refer to the ‘development dimension’. The document presented by the Group of Friends of Development corrects this misconception – that development dimension means technical assistance.

The real “development” imperative is ensuring that the interest of Intellectual Property owners is not secured at the expense of the users of IP, of consumers at large, and of public policy in general. …

The legal monopoly granted to IP owners is an exceptional departure from the general principle of competitive markets as the best guarantee for securing the interest of society. The rationale for the exception is not that extraction of monopoly profits by the innovator is, of and in itself, good for society and so needs to be promoted. Rather, that properly controlled, such a monopoly, by providing an incentive for innovation, might produce sufficient benefits for society to compensate for the immediate loss to consumers as a result of the existence of a monopoly market instead of a competitive market. Monopoly rights, then, granted to IP holders is a special incentive that needs to be carefully calibrated by each country, in the light of its own circumstances, taking into account the overall costs and benefits of such protection. …

The current emphasis of Technical Assistance on implementation and enforcement issues is misplaced. IP Law enforcement is embedded in the framework of all law enforcement in the individual countries. It is unrealistic, and even undesirable to expect that the enforcement of IP laws will be privileged over the enforcement of other laws in the country. Society faces a considerable challenge to effectively protect, and resolve disputes over, physical property. To expect that the police, the lawyers and the courts should dedicate a sizable part of society’s enforcement resources for protecting intangible intellectual property, is unrealistic. …

In conclusion, it is important that developed countries and WIPO acknowledge that IP protection is an important policy instrument for developing countries, one that needs to be used carefully. While the claimed benefits of strong IP protection for developing countries are a matter of debate – and nearly always in the distant future – such protection invariably entails substatial real an immediate costs for these countries. In formulating its IP policy, therefore, each country needs to have sufficient flexibility so that the cost of IP protection does not outweigh the benefits.

Thomas Macaulay told us copyright law is a tax on readers for the benefit of writers, a tax that shouldn’t last a day longer than necessary. …

Since only about 4 per cent of copyrighted works more than 20 years old are commercially available, this locks up 96 per cent of 20th century culture to benefit 4 per cent. The harm to the public is huge, the benefit to authors, tiny. …

We need to deconstruct the culture of IP stupidity, to understand it so we can change it. But this is a rich and complex stupidity, like a fine Margaux. I can only review a few flavours.

Maximalism: The first thing to realize is that many decisions are driven by honest delusion, not corporate corruption. The delusion is maximalism: the more intellectual property rights we create, the more innovation. This is clearly wrong; rights raise the cost of innovation inputs (lines of code, gene sequences, data.) Do their monopolistic and anti-competitive effects outweigh their incentive effects? That’s the central question, but many of our decision makers seem never to have thought of it.

The point was made by an exchange inside the Committee that shaped Europe’s ill-starred Database Directive. It was observed that the US, with no significant property rights over unoriginal compilations of data, had a much larger database industry than Europe which already had significant “sweat of the brow” protection in some countries. Europe has strong rights, the US weak. The US is winning.

Did this lead the committee to wonder for a moment whether Europe should weaken its rights? No. Their response was that this showed we had to make the European rights much stronger. …

Authorial Romance: Part of the delusion depends on the idea that inventors and artists create from nothing. Who needs a public domain of accessible material if one can create out of thin air? But in most cases this simply isn’t true; artists, scientists and technologists build on the past. …

An Industry Contract: Who are the subjects of IP? They used to be companies. You needed a printing press or a factory to trigger the landmines of IP. The law was set up as a contract between industry groups. This was a cosy arrangement, but it is no longer viable. The citizen-publishers of cyberspace, the makers of free software, the scientists of distributed data-analysis are all now implicated in the IP world. The decision-making structure has yet to adjust. …

Fundamentally, though, the views I have criticised here are not merely stupidity. They constitute an ideology, a worldview, like flat earth-ism. …

What can we use instead of gasoline in cars?

It is East Kansas Agri-Energy’s ethanol facility, one of 100 or so such heartland garrisons in America’s slowly gathering battle to reduce its dependence on fossil fuels. The plant processes about 13 million bushels of corn to produce approximately 36 million gal. of ethanol a year. “That’s enough high-quality motor fuel to replace 55,000 barrels of imported petroleum,” the plant’s manager, Derek Peine, says. …

It takes five barrels of crude oil to produce enough gasoline (nearly 97 gal.) to power a Honda Civic from New York to California. …

Ethanol/E85

E85 is a blend of 85 percent ethanol and 15 percent gasoline. … A gallon of E85 has an energy content of about 80,000 BTU, compared to gasoline’s 124,800 BTU. So about 1.56 gal. of E85 takes you as far as 1 gal. of gas.

Case For: Ethanol is an excellent, clean-burning fuel, potentially providing more horsepower than gasoline. In fact, ethanol has a higher octane rating (over 100) and burns cooler than gasoline. However, pure alcohol isn’t volatile enough to get an engine started on cold days, hence E85. …

Cynics claim that it takes more energy to grow corn and distill it into alcohol than you can get out of the alcohol. However, according to the DOE, the growing, fermenting and distillation chain actually results in a surplus of energy that ranges from 34 to 66 percent. Moreover, the carbon dioxide (CO2) that an engine produces started out as atmospheric CO2 that the cornstalk captured during growth, making ethanol greenhouse gas neutral. Recent DOE studies note that using ethanol in blends lowers carbon monoxide (CO) and CO2 emissions substantially. In 2005, burning such blends had the same effect on greenhouse gas emissions as removing 1 million cars from American roads. …

One acre of corn can produce 300 gal. of ethanol per growing season. So, in order to replace that 200 billion gal. of petroleum products, American farmers would need to dedicate 675 million acres, or 71 percent of the nation’s 938 million acres of farmland, to growing feedstock. Clearly, ethanol alone won’t kick our fossil fuel dependence–unless we want to replace our oil imports with food imports. …

Biodiesel

Fuels for diesel engines made from sources other than petroleum are known as biodiesel. Among the common sources are vegetable oils, rendered chicken fat and used fry oil. …

Case For: Modern diesel engines can run on 100 percent biodiesel with little degradation in performance compared to petrodiesel because the BTU content of both fuels is similar–120,000 to 130,000 BTU per gallon. In addition, biodiesel burns cleaner than petrodiesel, with reduced emissions. Unlike petrodiesel, biodiesel molecules are oxygen-bearing, and partially support their own combustion.

According to the DOE, pure biodiesel reduces CO emissions by more than 75 percent over petroleum diesel. A blend of 20 percent biodiesel and 80 percent petrodiesel, sold as B20, reduces CO2 emissions by around 15 percent.

Case Against: Pure biodiesel, B100, costs about $3.50–roughly a dollar more per gallon than petrodiesel. And, in low temperatures, higher-concentration blends–B30, B100–turn into waxy solids and do not flow. Special additives or fuel warmers are needed to prevent fuel waxing. …

Electricity

Case For: Vehicles that operate only on electricity require no warmup, run almost silently and have excellent performance up to the limit of their range. Also, electric cars are cheap to “refuel.” At the average price of 10 cents per kwh, it costs around 2 cents per mile. …

A strong appeal of the electric car–and of a hybrid when it’s running on electricity–is that it produces no tailpipe emissions. Even when emissions created by power plants are factored in, electric vehicles emit less than 10 percent of the pollution of an internal-combustion car.

Case Against: Pure electric cars still have limited range, typically no more than 100 to 120 miles. In addition, electrics suffer from slow charging, which, in effect, reduces their usability….

And then there’s the environmental cost. Only 2.3 percent of the nation’s electricity comes from renewable resources; about half is generated in coal-burning plants.

Hydrogen

Hydrogen is the most abundant element on Earth, forming part of many chemical compounds. Pure hydrogen can be made by electrolysis–passing electricity through water. This liberates the oxygen, which can be used for many industrial purposes. Most hydrogen currently is made from petroleum.

Case For: Though hydrogen can fuel a modified internal-combustion engine, most see hydrogen as a way to power fuel cells to move cars electrically. The only byproduct of a hydrogen fuel cell is water.

Case Against: … And, despite the chemical simplicity of electrolysis, producing hydrogen is expensive and energy consuming. It takes about 17 kwh of electricity, which costs about $1.70, to make just 100 cu. ft. of hydrogen. That amount would power a fuel cell vehicle for about 20 miles.

According to the article: “Hundreds of cases involving breath-alcohol tests have been thrown out by Seminole County judges in the past five months because the test’s manufacturer will not disclose how the machines work.”

This is the right decision. Throughout history, the government has had to make the choice: prosecute, or keep your investigative methods secret. They couldn’t have both. If they wanted to keep their methods secret, they had to give up on prosecution.

People have the right to confront their accuser. People have a right to examine the evidence against them, and to contest the validity of that evidence.

Banishment is the absolute worst punishment any multi-player online role-playing game can impose on a player. Which is to say that a painless execution is the absolute worst punishment any game society can impose on the characters who are its citizens. Torture is not an option. Imprisonment and fines can be imposed, true, but as soon as the player behind the character finds that these punishments are too onerous, she can simply terminate her account and stop logging in; the rest of the deterrent value of the punishment evaporates. It’s hard to hold characters accountable.

The Boston Tea Party was the expression of mercantile anger at taxes: the protesters wanted was a revision of British tax policies to favor colonial merchants at the expense of merchants in England. Economically speaking, the entire American Revolution was a scheme to improve the fortunes of colonial elites. But to convince their future countrymen to go along with their tax revolt, they developed one of the most inspiring ideologies of liberty and justice the world has ever seen. ‘No taxation without representation’ is a slogan that transforms ‘mere’ economics into egalitarianism. There are plenty of thinkers who will tell you societies as a whole can often reap enormous benefits by letting one particular group get rich; these benefits are hardly confined to material wealth.

[The key to economic growth lies not just in the ability to attract the creative class, but to translate that underlying advantage into creative economic outcomes in the form of new ideas, new high-tech businesses and regional growth. To better gauge these capabilities, I developed a new measure called the Creativity Index (column 1). The Creativity Index is a mix of four equally weighted factors: the creative class share of the workforce (column 2 shows the percentage; column 3 ranks cities accordingly); high-tech industry, using the Milken Institute’s widely accepted Tech Pole Index, which I refer to as the High-Tech Index (column 4); innovation, measured as patents per capita (column 5); and diversity, measured by the Gay Index, a reasonable proxy for an area’s openness to different kinds of people and ideas (column 6).]

This young man and his lifestyle proclivities represent a profound new force in the economy and life of America. He is a member of what I call the creative class: a fast-growing, highly educated, and well-paid segment of the workforce on whose efforts corporate profits and economic growth increasingly depend. Members of the creative class do a wide variety of work in a wide variety of industries—from technology to entertainment, journalism to finance, high-end manufacturing to the arts. They do not consciously think of themselves as a class. Yet they share a common ethos that values creativity, individuality, difference, and merit. …

Most civic leaders, however, have failed to understand that what is true for corporations is also true for cities and regions: Places that succeed in attracting and retaining creative class people prosper; those that fail don’t. …

The distinguishing characteristic of the creative class is that its members engage in work whose function is to “create meaningful new forms.” The super- creative core of this new class includes scientists and engineers, university professors, poets and novelists, artists, entertainers, actors, designers, and architects, as well as the “thought leadership” of modern society: nonfiction writers, editors, cultural figures, think-tank researchers, analysts, and other opinion-makers. Members of this super-creative core produce new forms or designs that are readily transferable and broadly useful—such as designing a product that can be widely made, sold and used; coming up with a theorem or strategy that can be applied in many cases; or composing music that can be performed again and again.

Beyond this core group, the creative class also includes “creative professionals” who work in a wide range of knowledge-intensive industries such as high-tech sectors, financial services, the legal and healthcare professions, and business management. These people engage in creative problem-solving, drawing on complex bodies of knowledge to solve specific problems. Doing so typically requires a high degree of formal education and thus a high level of human capital. People who do this kind of work may sometimes come up with methods or products that turn out to be widely useful, but it’s not part of the basic job description. What they are required to do regularly is think on their own. They apply or combine standard approaches in unique ways to fit the situation, exercise a great deal of judgment, perhaps try something radically new from time to time. …

The creative class now includes some 38.3 million Americans, roughly 30 percent of the entire U.S. workforce—up from just 10 percent at the turn of the 20th century and less than 20 percent as recently as 1980. The creative class has considerable economic power. In 1999, the average salary for a member of the creative class was nearly $50,000 ($48,752), compared to roughly $28,000 for a working-class member and $22,000 for a service-class worker. …

Chicago, a bastion of working-class people that still ranks among the top 20 large creative centers, is interesting because it shows how the creative class and the traditional working class can coexist. But Chicago has an advantage in that it is a big city, with more than a million members of the creative class. The University of Chicago sociologist Terry Clark likes to say Chicago developed an innovative political and cultural solution to this issue. Under the second Mayor Daley, the city integrated the members of the creative class into the city’s culture and politics by treating them essentially as just another “ethnic group” that needed sufficient space to express its identity. …

Why do some places become destinations for the creative while others don’t? Economists speak of the importance of industries having “low entry barriers,” so that new firms can easily enter and keep the industry vital. Similarly, I think it’s important for a place to have low entry barriers for people—that is, to be a place where newcomers are accepted quickly into all sorts of social and economic arrangements. All else being equal, they are likely to attract greater numbers of talented and creative people—the sort of people who power innovation and growth. …

Cities and regions that attract lots of creative talent are also those with greater diversity and higher levels of quality of place. That’s because location choices of the creative class are based to a large degree on their lifestyle interests, and these go well beyond the standard “quality-of-life” amenities that most experts think are important. …

When we compared these two lists with more statistical rigor, his Gay Index turned out to correlate very strongly to my own measures of high-tech growth. Other measures I came up with, like the Bohemian Index—a measure of artists, writers, and performers—produced similar results.

Talented people seek an environment open to differences. Many highly creative people, regardless of ethnic background or sexual orientation, grew up feeling like outsiders, different in some way from most of their schoolmates. When they are sizing up a new company and community, acceptance of diversity and of gays in particular is a sign that reads “non-standard people welcome here.” …

They favor active, participatory recreation over passive, institutionalized forms. They prefer indigenous street-level culture—a teeming blend of cafes, sidewalk musicians, and small galleries and bistros, where it is hard to draw the line between performers and spectators. They crave stimulation, not escape. They want to pack their time full of dense, high-quality, multidimensional experiences. Seldom has one of my subjects expressed a desire to get away from it all. They want to get into it all, and do it with eyes wide open.

Creative class people value active outdoor recreation very highly. They are drawn to places and communities where many outdoor activities are prevalent—both because they enjoy these activities and because their presence is seen as a signal that the place is amenable to the broader creative lifestyle. …

Places are also valued for authenticity and uniqueness. Authenticity comes from several aspects of a community—historic buildings, established neighborhoods, a unique music scene, or specific cultural attributes. It comes from the mix—from urban grit alongside renovated buildings, from the commingling of young and old, long-time neighborhood characters and yuppies, fashion models and “bag ladies.” An authentic place also offers unique and original experiences. Thus a place full of chain stores, chain restaurants, and nightclubs is not authentic. You could have the same experience anywhere. …

Even as places like Austin and Seattle are thriving, much of the country is failing to adapt to the demands of the creative age. It is not that struggling cities like Pittsburgh do not want to grow or encourage high-tech industries. In most cases, their leaders are doing everything they think they can to spur innovation and high-tech growth. But most of the time, they are either unwilling or unable to do the things required to create an environment or habitat attractive to the creative class. They pay lip service to the need to “attract talent,” but continue to pour resources into recruiting call centers, underwriting big-box retailers, subsidizing downtown malls, and squandering precious taxpayer dollars on extravagant stadium complexes. Or they try to create facsimiles of neighborhoods or retail districts, replacing the old and authentic with the new and generic—and in doing so drive the creative class away.

It is a telling commentary on our age that at a time when political will seems difficult to muster for virtually anything, city after city can generate the political capital to underwrite hundreds of millions of dollars of investments in professional sports stadiums. And you know what? They don’t matter to the creative class. Not once during any of my focus groups and interviews did the members of the creative class mention professional sports as playing a role of any sort in their choice of where to live and work. What makes most cities unable to even imagine devoting those kinds of resources or political will to do the things that people say really matter to them?

The answer is simple. These cities are trapped by their past. Despite the lip service they might pay, they are unwilling or unable to do what it takes to attract the creative class. The late economist Mancur Olson long ago noted that the decline of nations and regions is a product of an organizational and cultural hardening of the arteries he called “institutional sclerosis.” Places that grow up and prosper in one era, Olson argued, find it difficult and often times impossible to adopt new organizational and cultural patterns, regardless of how beneficial they might be. Consequently, innovation and growth shift to new places, which can adapt to and harness these shifts for their benefit. …

Most experts and scholars have not even begun to think in terms of a creative community. Instead, they tend to try to emulate the Silicon Valley model which author Joel Kotkin has dubbed the “nerdistan.” But the nerdistan is a limited economic development model, which misunderstands the role played by creativity in generating innovation and economic growth. Nerdistans are bland, uninteresting places with acre upon acre of identical office complexes, row after row of asphalt parking lots, freeways clogged with cars, cookie-cutter housing developments, and strip-malls sprawling in every direction. Many of these places have fallen victim to the very kinds of problems they were supposed to avoid. …

Yet if you ask most community leaders what kinds of people they’d most want to attract, they’d likely say successful married couples in their 30s and 40s—people with good middle-to-upper-income jobs and stable family lives. I certainly think it is important for cities and communities to be good for children and families. But less than a quarter of all American households consist of traditional nuclear families, and focusing solely on their needs has been a losing strategy, one that neglects a critical engine of economic growth: young people.

Young workers have typically been thought of as transients who contribute little to a city’s bottom line. But in the creative age, they matter for two reasons. First, they are workhorses. They are able to work longer and harder, and are more prone to take risks, precisely because they are young and childless. In rapidly changing industries, it’s often the most recent graduates who have the most up-to-date skills. Second, people are staying single longer. The average age of marriage for both men and women has risen some five years over the past generation. College-educated people postpone marriage longer than the national averages. Among this group, one of the fastest growing categories is the never-been-married. To prosper in the creative age, regions have to offer a people climate that satisfies this group’s social interests and lifestyle needs, as well as address those of other groups. …

Turnpikes, roads, & tolls

British turnpikes were a controversial response to a serious problem. Traditionally, the King’s Highway was open to all. The problem was how to keep it in good condition. As commerce grew, the need to maintain roads became acute. At first, in Elizabethan times, laws were enacted compelling all able-bodied commoner males to devote several days a year to labor on the highways. (See [1,66,80] for references for the background information as well as other items below that are not attributed otherwise.) The inequitable distribution of the burden this imposed and the lack of effective control mechanisms by the central government led to many complaints. As a result, in 1663, the first turnpike was authorized. A local group was authorized to create a turnpike trust that would borrow money to improve a section of a road, and then collect tolls from travelers for passage over that section of the road. This venture was set up (as were all subsequent turnpikes) as an ostensibly non-profit trust. (There were opportunities for profits there, for example in payment of above-market fees and other abuses, but those were illicit, and in any case were not the high profits that other, more private, enterprises, such as lighthouses and canals, offered.) The reason for the non-profit nature of turnpikes was presumably to allay concerns about a violation of the ancient principle that the King’s Highway was open to all. Still, this turnpike was very controversial (as were many later ones). Apparently largely for that reason, it took until 1695 before the next turnpike was set up [2].

In the early 18th century, the turnpike movement took off in earnest. Although there were frequent protests (sometimes violent, as in the burning of the toll gates around Bristol in 1727 and 1735), by mid-1830s there were over 20,000 miles of turnpikes in England. …

Tolls were usually doubled on Sundays for ordinary commercial traffic, but were eliminated for travel to or from church. They also “were never levied on foot passengers, and were thus unfelt by the labouring poor” (p. 124 of [80]). There were also options in many cases for a flat fee for annual access. Still, there were countless controversies about the toll, “the collection of which led to endless evasions, inequalities and favouritisms of all kinds, arbitrary exactions, and systematic petty embezzlements” (p. 136 of [80]). …

… road tolls are coming back as a result of growing congestion and improved technology. Unlike telecommunications, where technology is increasing capacity of fiber, coax, and radio transmissions, building new roads is increasingly difficult, and making existing ones carry more traffic can only be done to a limited extent. At the same time, electronic means for monitoring traffic and collecting tolls are improving, and we see central business districts in Norway, Singapore, and London imposing tolls. Most of these systems do raise privacy issues, too, since they are centralized ones with information about users, or at least cars. Still, there is a strong tendency to introduce ever more detailed monitoring of traffic, often with the explicit goal of charging users according to their level of activity (whether by governments or by insurance companies).

Arguments against the Web’s ungovernability

Nonetheless, the claim that the Internet is ungovernable by its nature is more of a hope than a fact. It rests on three widely accepted beliefs, each of which has become dogma to webheads. First, the Net is said to be too international to oversee: there will always be some place where people can set up a server and distribute whatever they want. Second, the Net is too interconnected to fence in: if a single person has something, he or she can instantly make it available to millions of others. Third, the Net is too full of hackers: any effort at control will invariably be circumvented by the world’s army of amateur tinkerers, who will then spread the workaround everywhere.

Unfortunately, current evidence suggests that two of the three arguments for the Net’s uncontrollability are simply wrong; the third, though likely to be correct, is likely to be irrelevant. In consequence, the world may well be on the path to a more orderly electronic future-one in which the Internet can and will be controlled. If so, the important question is not whether the Net can be regulated and monitored, but how and by whom. …

As Swaptor shows, the Net can be accessed from anywhere in theory, but as a practical matter, most out-of-the-way places don’t have the requisite equipment. And even if people do actually locate their services in a remote land, they can be easily discovered. …

Rather than being composed of an uncontrollable, shapeless mass of individual rebels, Gnutella-type networks have identifiable, centralized targets that can easily be challenged, shut down or sued. Obvious targets are the large backbone machines, which, according to peer-to-peer developers, can be identified by sending out multiple searches and requests. By tracking the answers and the number of hops they take between computers, it is possible not only to identify the Internet addresses of important sites but also to pinpoint their locations within the network.

Once central machines have been identified, companies and governments have a potent legal weapon against them: their Internet service providers. …

In other words, those who claim that the Net cannot be controlled because the world’s hackers will inevitably break any protection scheme are not taking into account that the Internet runs on hardware – and that this hardware is, in large part, the product of marketing decisions, not technological givens.

Tom Hawk, general manager for enterprise storage at IBM, says that in the next three years, humanity will generate more data–from websites to digital photos and video–than it generated in the previous 1,000 years. … In 1996, companies spent 11 percent of their IT budgets on storage, but that figure will likely double to 22 percent in 2007, according to International Technology Group of Los Altos, CA.

… the Pentagon generates tens of millions of images from personnel files each year; the Clinton White House generated 38 million e-mail messages (and the current Bush White House is expected to generate triple that number); and the 2000 census returns were converted into more than 600 million TIFF-format image files, some 40 terabytes of data. A single patent application can contain a million pages, plus complex files like 3-D models of proteins or CAD drawings of aircraft parts. All told, NARA expects to receive 347 petabytes … of electronic records by 2022.

Currently, the Archives holds only a trivial number of electronic records. Stored on steel racks in NARA’s [National Archives and Records Administration] 11-year-old facility in College Park, the digital collection adds up to just five terabytes. Most of it consists of magnetic tapes of varying ages, many of them holding a mere 200 megabytes apiece–about the size of 10 high-resolution digital photographs.

… [John Charles] Fremont did little else in his first few months in command in Missouri … He did, however, manage to get some criticisms over his choices for staff positions. Unlike many generals, Fremont wanted to be allowed to pick and choose each member of his staff and his bodyguard, and he did in fact do so. One priority, it seems, was that a candidate had to have a funny name, or at least a European one. In fact, the majority of Fremont’s staff members seem to have been Europeans, primarily Germans and Hungarians. A large amount of them seem to have been extra-legally commissioned and most had no idea of how the war in the West was to be fought. Those who knew military tactics advocated using the outdated tactics of Napoleon and Frederick the Great, as well as the Baron Jomini and that lot. A lot of them were as inefficient as possible, some were even minor nobility, and many were corrupt, mixed in with anti-Lincoln groups, Know-Nothings, and the like. …

The fact that the list of the staff members (about three hundred men in his personal bodyguard alone and a good thirty members, all over five foot eleven inches in height, made up his staff) is practically endless also bothered some individuals, especially when scrolling down the list one reads many times over French or Italian names, or running over several individuals with the surnames of ‘Kalmanuezze’ or ‘Zagonyi’. A lot of these fellows spoke English very badly at best, which only deepened the stupidity of the situation. When Fremont’s opponent in the field (not that Fremont ever bothered to fight him), General Albert Sidney Johnston, [Confederate States of America], was shown a copy of the staff list at his headquarters in Nashville, he simply commented with one of his deep chuckles “There’s too much tail to that kite!” Even the locals could feel their stomachs turn when they saw Fremont’s bodyguards and staff officers walking the streets, many wreaking of perfume, and wearing ridiculous (overly grandiose) uniforms with plumes and braids. Such men were the reason that the locals gave the men of Fremont’s staff (and the General himself) the somewhat embarrassing title ‘Chicken Guts’.

At last count (by Sheriff Hopper toting it up in his head), 16 people make Mentone their home and 55 others are spread throughout the rest of Loving County’s 645 square miles of parched, salty West Texas grassland and rattlesnakes — about one person for every nine square miles. …

Yet it is modest enough, as a plaque outside the courthouse confesses: “Mentone has no water system (water is hauled in) nor does it have a bank, doctor, hospital, newspaper, lawyer, civic club or cemetery.”

And since Mentone is the only town, neither does Loving County.

What it does have is the Boot Track Café (open mornings), a post office, a gas station and the yellow Deco two-story courthouse. There are two roads. There is no operating church, although the county’s oldest building, a 1910 schoolhouse, is open for nondenominational worship. Seven children ride a school bus 33 miles to Wink in the next county.

… The material described the plans of a Libertarian faction in its own words “to win most of the elected offices in the county administration” and “restore to freedom” Loving County. The blueprint, called “Restoring Loving County,” said that land was hard to come by but that a ranch had been split up and members were in the process of buying sections.

“The people who are living there will be able to register to vote,” it said. “They must swear that they intend to make Loving their home.”

The goal, said an e-mail message attributed to a group member, was to move in enough Libertarians “to control the local government and remove oppressive regulations (such as planning and zoning, and building code requirements) and stop enforcement of laws prohibiting victimless acts among consenting adults such as dueling, gambling, incest, price-gouging, cannibalism and drug handling.”

Global cybercrime generated a higher turnover than drug trafficking in 2004 and is set to grow even further with the wider use of technology in developing countries, a top expert said on Monday.

No country is immune from cybercrime, which includes corporate espionage, child pornography, stock manipulation, extortion and piracy, said Valerie McNiven, who advises the U.S. Treasury on cybercrime.

“Last year was the first year that proceeds from cybercrime were greater than proceeds from the sale of illegal drugs, and that was, I believe, over $105 billion,” McNiven told Reuters.

“Cybercrime is moving at such a high speed that law enforcement cannot catch up with it.”

For example, Web sites used by fraudsters for “phishing” — the practice of tricking computer users into revealing their bank details and other personal data — only stayed on the Internet for a maximum of 48 hours, she said. …

Developing countries which lack the virtual financial systems available elsewhere are easier prey for cybercrime perpetrators, who are often idle youths looking for quick gain.

“When you have identity thefts or corruption and manipulation of information there (developing countries), it becomes almost more important because … their systems start getting compromised from the get-go,” she said.
